Please read these Terms and Conditions ("Terms", "Terms and Conditions") carefully before using the Sparklery website or engaging with any services offered by Sparklery ("Services").
1. Acceptance of Terms
By accessing or using Sparklery Services, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Services.
2. Service Description
Sparklery offers spiritual guidance, tarot reading, astrology readings, energy work, and educational services related to these fields. All Services are provided as-is with no guarantees of specific outcomes or results.
3. Professional Disclaimer
Sparklery Services are provided for entertainment, spiritual guidance, and personal development purposes only. Doriana is not a licensed medical professional, psychologist, therapist, counselor, financial advisor, or legal professional.
No Services should be construed as licensed therapeutic, medical, legal, or financial advice. Clients are responsible for seeking appropriate professional advice for serious matters concerning physical health, mental health, legal issues, or financial decisions.
The information provided through Sparklery Services is not intended to diagnose, treat, cure, or prevent any physical or mental health condition, or to replace professional treatment or advice.
4. Intellectual Property Rights
All content, materials, methodologies, techniques, branding elements, and the name "Sparklery" are the exclusive intellectual property of Doriana at Sparklery, the owner of the domain ‘sparklery.co’. This includes but is not limited to: website content, session recordings, readings, reports, guides, methodologies, techniques, graphics, and teaching materials.
While clients may record sessions for personal use, any reproduction, distribution, public sharing, or commercial use of any content from Sparklery, including session recordings, is strictly prohibited without prior written consent.
5. Client Responsibilities
By engaging with Sparklery Services, clients agree to:
Provide accurate and truthful information
Participate in good faith
Use Services for lawful purposes only
Take responsibility for their own decisions and actions
Respect intellectual property rights
Maintain appropriate conduct during interactions
6. Cancellation and Refund Policy
Client Cancellations
Due to the personalized nature of Sparklery Services and the preparation work involved before sessions, client cancellations are not eligible for refunds once an order has been placed. Upon booking, you agree that all sales are final.
Clients may reschedule a session once per order with a minimum of 72 hours (3 full days) advance notice. Rescheduling requests with less than 72 hours' notice cannot be accommodated, and the original appointment will be forfeited without refund.
If you are unable to attend your scheduled session, you may transfer your booking as a gift to another person by contacting us at least 72 hours before the scheduled time. The recipient must be informed of and agree to all applicable Terms and Conditions.
Provider Cancellations
Sparklery reserves the right to cancel or reschedule sessions at its sole discretion without providing explanation. In the event that Sparklery cancels a session, clients will be offered either a full refund or the option to reschedule. No additional compensation will be provided beyond the original payment amount.
Sparklery is not liable for any incidental or consequential costs or damages resulting from canceled or rescheduled sessions, including but not limited to travel expenses, time off work, or technological arrangements made by the client.
No-Shows
If a client fails to attend a scheduled session without prior notice ('no-show'), the session will be considered completed and no refund or rescheduling option will be provided.
7. Session Recording and Data Handling
By engaging with Sparklery Services, clients acknowledge and consent that sessions may be recorded and notes may be taken for training purposes, quality improvement, and protection of both parties. These recordings remain the property of Sparklery and will be kept confidential except as required by law.
Sparklery collects and processes personal data (including but not limited to name, email address, birth information for astrological services) for the sole purpose of providing the requested Services. Payment processing is handled by third-party providers (Squarespace, PayPal, etc.), and Sparklery does not store payment details.
Personal data will be retained for as long as necessary to provide Services and for legal and business record purposes. Sparklery complies with GDPR and applicable Romanian data protection laws. For more information about data handling, please refer to our Privacy Policy.
8. Limitation of Liability
To the maximum extent permitted by applicable law, Sparklery and Doriana shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:
a) Your use of or inability to use the Services b) Any decisions or actions taken based on information or advice provided through the Services c) Any outcomes or results following the use of the Services d) Technical issues that may affect service delivery e) Unauthorized access to or alteration of your data
In no event shall Sparklery's total liability for all claims related to the Services exceed the amount you paid for the specific Service in question.
9. Testimonials and Reviews
By providing testimonials, reviews, or feedback, you grant Sparklery the right to use such content for marketing purposes. Identifying information will be modified or removed upon request. Sparklery reserves the right to edit testimonials for clarity or length while maintaining the essence of the original statement.
10. Right to Refuse Service
Sparklery reserves the right to refuse service to anyone for any reason at any time. This includes terminating sessions that Sparklery determines to be inappropriate, harmful, outside the scope of services, or in violation of these Terms.
11. Age Restriction
Sparklery Services are intended for individuals 18 years of age or older. Individuals under 18 may only use the Services with the involvement and consent of a parent or legal guardian.
12. Force Majeure
Sparklery shall not be liable for any failure to perform its obligations where such failure is a result of acts of nature (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities (whether war is declared or not), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, government sanction, blockage, embargo, labor dispute, strike, lockout, internet service provider failure or delay, or any other circumstances beyond the reasonable control of Sparklery.
13. Gift Certificates and Promotions
Gift certificates and promotional offers are subject to specific terms outlined at the time of purchase or offering. Gift certificates have no cash value, are non-refundable, and expire one year from the date of purchase unless otherwise specified. Promotional discounts cannot be combined with other offers unless explicitly stated.
14. Confidentiality
Sparklery respects client confidentiality and will not disclose personal details or the content of sessions to third parties except: (a) with explicit client consent, (b) where required by law, (c) in anonymized form for educational or professional development purposes with all identifying information removed, or (d) when disclosure is necessary to prevent serious harm. Clients agree to maintain the confidentiality of any proprietary techniques, methodologies, or practices shared during sessions.
15. Disclaimer for Third-Party Links
The Sparklery website may contain links to third-party websites or services that are not owned or controlled by Sparklery. Sparklery has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services. Clients acknowledge and agree that Sparklery shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods, or services available on or through any such websites or services.
16. Copyright Infringement Notification
If you believe that any content on the Sparklery website infringes upon your copyright, please contact us providing: (a) a physical or electronic signature of the copyright owner, (b) identification of the copyrighted work claimed to have been infringed, (c) identification of the material that is claimed to be infringing, (d) your contact information, (e) a statement that you have a good faith belief that use is not authorized, and (f) a statement that the information is accurate and, under penalty of perjury, that you are the copyright owner or authorized to act on behalf of the owner.
17. Language of Services
Sparklery services are primarily provided in English and Romanian. While efforts may be made to accommodate other languages, Sparklery cannot guarantee the accuracy of information conveyed in languages other than those specifically listed, and cannot be held responsible for any misunderstandings resulting from language barriers.
18. Virtual Session Requirements
Clients are responsible for ensuring they have appropriate technology (computer/device, internet connection, microphone, camera if applicable) to participate in virtual sessions. Sparklery is not responsible for technological failures on the client's end that may affect service delivery. If technical issues prevent delivery of a scheduled service, resolution will be handled case-by-case at Sparklery's discretion.
19. Content Accuracy
While Sparklery makes every effort to ensure the accuracy of information provided, all content is subject to interpretation. Spiritual, intuitive, and divinatory readings are, by their nature, subjective. Sparklery does not warrant or guarantee the accuracy of any interpretations, predictions, or guidance provided through its Services.
20. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of Romania and applicable European Union regulations. Any dispute arising from or related to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts in Romania.
21. Changes to Terms
Sparklery reserves the right to modify these Terms at any time. We will provide notice of significant changes by updating the "Last Updated" date at the top of these Terms. Your continued use of the Services following any changes indicates your acceptance of the revised Terms.
22. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
